3. Commission, Rewards, and Penalties:

3.1 Commission Structure: Sellers acknowledge that Never Give Up Day Marketplace acts as the commissioner, receiving all monies from orders and withholding a commission for each transaction. Sellers will be allocated their earnings according to the payment terms outlined in the Payment Terms document.

3.2 Violation Consequences: Sellers understand that breaching the Terms of Use may result in account suspension or termination.

4. Listing and Selling Items

4.1 By listing items on the Platform, you warrant that you have the legal right to sell those items and that they comply with all applicable laws and regulations.

4.2 You agree to provide accurate and detailed descriptions of your items, including any relevant terms and conditions of sale.

4.3 You are responsible for setting the price of your items.

4.4 Never Give Up Day Marketplace disclaims any liability for goods and services provided by sellers.

5.Seller Responsibilities

5.1 Order Fulfillment: Sellers are responsible for fulfilling orders promptly, including packaging, shipping, and providing tracking information. Sellers must update order statuses on the Platform promptly.

5.2 Return Policies: Each seller must clearly outline their return policies to buyers. Sellers have the autonomy to implement their own return policies.

5.3 Marketplace Compliance: All sellers agree not to engage in marketplace breaches or circumvent the Platform. All transactions and communications must occur within the Platform.

6. Shipping and Autonomy

6.1 Vendor Autonomy: While the Platform sets guidelines for shipping and return policies, sellers have autonomy in managing their shipping and return processes.

6.2 General Standards: Maintaining general standards ensures a positive overall customer experience, even when shipping is managed by individual sellers.

7. Governing Law

7.1 These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

8. Changes to Terms
Never Give Up Day Marketplace reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on the Platform.
